Emerald Group CEO held on remand, bail request yet to be heard

PHUKET: The Phuket Provincial Court today confirmed that whether or not Emerald Group CEO Sawit Ketroj, who faces a charge of defrauding the public over Phuket condo units not being completed, will be granted bail has yet to be decided as he has yet to be arraigned.

An official of the court, who asked not to be named, confirmed that Mr Sawit is currently being detained in the detention cells at the court as he has been denied police bail.

However, the official could not confirm when Mr Sawit’s request to the court for bail will be heard.

Capt Ekkachai Siri of the Tourist Police this afternoon confirmed to The Phuket News that police had yet to even complete their investigation in order to hand the case to the Public Prosecutor to present to the court the formal charge against Mr Sawit.

“Mr Sawit is being held in the detention cells at Phuket Provincial Court while police continue to gather evidence in the case against him,” Capt Ekkachai explained.

“The prosecutor has not even received the completed case file against Mr Sawit,” he added.

Mr Sawit surrendered himself at Patong Police Station at 4:40pm on Wednesday (May 2). He was wanted on an arrest warrant issued by the Phuket Provincial Court in October last year.

He faces a charge is breach of Section 22 of the Consumer Protection Act by providing false statements through advertisements published via the internet and other media, explained Tourist Police Chief Surachate Hakparn on Wednesday. (See story here.)

Following police receiving an initial complaint from one buyer against Mr Sawit for not delivering condo units as agreed by contract despite receiving more than B2.8 million in payments, Mr Sawit now stands accused of defrauding investors of a total of more than B127.5mn.

During questioning by police on Wednesday, Mr Sawit explained that the Emerald Group of companies could not complete the projects because they had run out of cash flow, Gen Surachet said.

Regardless, Capt Ekkachai told The Phuket News yesterday that police would request that the court deny Mr Sawit the option to post bail.
